CONDITIONS OF SALE

Ecorun OÜ, registry code 14265819, address Tuukri 64 – 57, 10152, Tallinn (hereinafter: Service Provider) and the client, who makes an order in the e-shop and identifies themselves by entering personal data on the order (hereinafter: Service User) concluded this Contract for Use of the E-Shop (hereinafter: Contract for Use).

  1. E-shop
    1.1. An Internet store created by the Service Provider through which the sale of products to the Service User takes place.
  2. General provisions
    2.1. In the regulation of the relations between the contracting parties, they shall be guided by the Law of Obligations Act, other laws and legal acts of the Republic of Estonia, and the provisions agreed upon in the Terms of Use.
    2.2. The Service Provider has the right to make changes to the offered E-Store service at any time.
    2.3. The Service Provider has the right to unilaterally change the terms of the User Agreement without having to notify the Service User of it by e-mail in writing.
    2.4. The Service User has the right to download or print the Terms of Use, which guarantees the opportunity to save and reproduce the relevant information on a permanent medium.
  3. Products and purchases
    3.1. The products shown are usually in stock. The availability of displayed products may change due to technical problems in the warehouse or the E-Store programs.
    3.2. If the item is out of stock, the order cannot be executed. In this case, an E-Shop employee shall contact the user and offer a possible new delivery time, replacing the product with another equivalent product of the same price and quality, or returns the money to the Service user money within 30 days.
    3.3. The displayed product images are illustrative and may differ from the actual product. The Service Provider shall do its best to display product information that is as good and correct as possible, but despite this, the product descriptions in the e-shop may not be exhaustive and may include unintentional errors.
    3.4. The products offered in the e-shop are sold to both private and legal persons.
    3.5. The Service User confirms that they are at least 15 years of age.
    3.6. The Service User selects the desired products, and then undertakes to enter the information required for executing the order (surname, first name, contact phone number, contact e-mail address, delivery address, postal code, and bank link), and pays for the products through the online bank link or through an invoice transfer.
    3.7. The Service User undertakes to present the correct data necessary for executing the order. The Service Provider is not liable for any failure to comply with the order caused by incorrect data provided by the Service User or for any consequence thereof.
    3.8. The sale is made when the Service Provider has confirmed the order and the Service Provider has received a payment for the order from the Service User.
  4. Prices and terms of payment
    4.1. All prices in E-Shop are displayed in euros and include VAT.
    4.2. The Service Provider has the right to change the prices displayed at any time. If the user submitted an order and paid for it in the e-shop, then the Service Provider undertakes to deliver the corresponding products to the user at the prices that were valid at the time of the order.
    4.3. The Service Provider has the right to refuse to execute an order in case of a technical error, which has caused the price of the product in the e-shop to be incorrect.

4.4. It is possible to securely pay for the orders through Estonian, Latvian, Lithuanian and Finnish bank links (Swedbank, SEB Bank, LHV bank, Citadele, and Luminor Bank etc.), with Mastecard, Visa and Paypal

4.5. The banklink payments and creditcard payments will be made outside of the e-shop environment of Ecorun OÜ through payment gateway provided by Montonio Finance OÜ. The e-shop of Ecorun OÜ does not have access to the client’s bank and credit card information.

4.6. After paying for the product, be sure to click on the button ‘Tagasi kaupmehe juurde’ (‘Return to the merchant’) in the bank.

  1. Delivery time and delivery terms

5.1. The Client can choose between different ways of delivering the product. The arrival of the product depends on the postal service chosen by the Client. Generally, the delivery time of products is less than 3 business days (Estonia) and less than 10 business days ( Finland, Latvia, Lithuania). In case we cannot deliver the product within 10 business days, we will inform you immediately. If necessary, you will be able to cancel the order and the paid money will be returned to you within 3 business days at the latest.

5.2. If a product arrives in the parcel machine, the Client will receive an SMS, which contains the door code, the location of the parcel machine, and the end of the deposit period. The product is stored in the parcel machine for 7 calendar days. After this deadline, the product will be returned to the E-Shop.

  1. Contract cancellation prior to the performance of the Contract by the Service Provider
    6.1. If the Service User wants to withdraw from the Contract of se after submitting an order and before the Service Provider has executed the order, the Service User undertakes to notify the Service Provider of it as soon as possible. The notice must be sent to the Service Provider’s e-mail address at info@ecorun.ee, and the notice must include the order number, from which the Service User wants to retreat, and the contact details of the Service User (first name, last name, date of the order, contact telephone).
    6.2. If the withdrawal application reaches the Service Provider after the Contract of Use has been executed by the Service Provider, the withdrawal from the contract shall take place in accordance with the ‘Return Right’ section of the Contract of Use.
    6.3. The Service Provider shall return the amount paid to the Service User not later than within 14 days from the date of receipt of the withdrawal application and delivery of returned products.
    6.4. The money shall be transferred to the same current account, from which it was received by the Service Provider.
    6.5. The Service Provider has the right to withdraw from the contract or to cancel the contract if the ordered products are out of stock.
    6.6. The Service Provider shall immediately inform the Service User about receding from or cancelling the contract by telephone, e-mail, or post. In such case, prepayments paid by the Service User shall immediately be returned to the User’s current account, but not later than within 14 days from receipt of the withdrawal application.
  2. Return right
    7.1. Purchased goods from the e-shop are subject to a 14-day return right from the receipt of the purchased product.
    7.2. Returned product must be clean, without defects, complete, in original packaging, and unused.
    7.3. To return a product, a corresponding request must be submitted to the e-mail address info@ecorun.ee and the product must be returned to the Service Provider’s address.
    7.4. Returns must be provided with the order number. If the Service User has submitted the order by logging in to the E-Shop and created a client account with correct data, it is sufficient if the Service User notifies their name, e-mail address, and the time of submission of the order.
    7.5. Upon return, the money shall be returned to the Service User within 14 days after the withdrawal application and the delivery of the products.
    7.6. The money shall be transferred to the same current account, from which it was received by the Service Provider.
    7.7. The transport costs of the return shall be covered by the Service User.
  3. Procedure for submitting claims
    8.1. The e-shop of Ecorun OÜ is responsible for the non-compliance of the sold products with the contractual terms or defect that arise from the delivery of the products to the Client.
    8.2. The Client is entitled to turn to the e-shop within two months upon occurrence of the defect, providing the invoice for the purchase of the product.
    8.3. In the event of a defective product, we ask that you stop using the product.
    8.4. The repair or replacement of defective products is agreed upon between the E-Shop and the Client. Repair costs are covered by the E-Shop.
    8.5. The E-Shop is not responsible for defects caused by the Client due to improper storage of the product or not using it purposefully.
    8.6 In the event of non-compliance or deficiencies in the Product, please submit a claim to info@ecorun.ee, stating the name of the ordering party, their contact phone number, the order number, and the exact description of the non-conformity or defect of the product.
    8.7. Claims for non-compliance or deficiencies in the product must be submitted within two months from the discovery of the product’s non-compliance or defect.
    8.9. All complaints shall be reviewed and the Client shall be contacted as soon as possible, but not later than within 14 days from receipt of the complaint.
    8.10. The Client has the right to demand reduction of the purchase price by the E-Shop or termination of the contract and the repayment for the products, if the E-Shop is not able to repair or replace the products, the repair or replacement of the products fails, the E-Shop has not eliminated the deficiency of the products within a reasonable time, or unjustified inconveniences have been caused for the Client.
  4. Privacy policy / data security
    9.1. The Service User gives clear and informed consent to the Service Provider for the processing of its personal data.
    9.2. The personal data learned by the Service Provider and entered by the Service User upon submitting the order are entered to the customer register and used to provide the sales service and offer products to the Service User.
    9.3. When requesting card data, the secure SSL data communication, as well as the MasterCard SecureCode and Verified by Visa security systems are used.
    9.4. The Service Provider does not see the card information entered. In order to make a transaction, the cardholder shall be directed to the secure environment of Stripe.
    9.5. The source of personal data is the creation of a client relationship upon the registration of an order in the e-shop.
    9.6. The personal data to be registered includes the Client’s data (given name, surname, address, telephone number, birth year, delivery method of the order, payment method used) and acceptance of the Contract for Use of the E-Shop.
    9.7. Personal data is processed by Ecorun OÜ.
    9.8. The personal data necessary for the delivery of the products to the Service User is forwarded to the courier company.
    9.9. Personal data protection is ensured by security measures.
    9.10. The Service Provider undertakes not to transfer the registered personal data to unauthorized persons.
    9.11. The Service Provider reserves the right to transfer the data concerning the Service User if the data is processed by a person for the fulfilment of the statutory obligation, who has the legal right to do it, or if it is done to protect the life, health, or freedom of the Service User.
    9.12. The Service User has the right to check the personal information relating to them, as well as to modify or remove it from the register.
    9.13. The Service User gives consent to the Service Provider to send an order confirmation to the e-mail address entered upon submission of the order.
    9.14. The Service User gives consent to the Service Provider to send sales offers to the e-mail address entered upon submission of the order, if they have put a tick in the respective window on the order submission page indicating their consent.
  5. Responsibility
    10.1. The Service Provider is liable in the extent of the price of the product.
    10.2. The Service User undertakes to only use the e-shop service for purposes consistent with the law and good practice.
    10.3. The Service User is responsible for the purchase and maintenance of software data communication systems on the necessary equipment, as well as any other expenses incurred in using the E-shop service.
    10.4. The Service User is fully responsible for the damages caused to the Service Provider, other Service Users, or third parties arising from using the E-shop against good practise.

    11.2. The customer service accepts calls between 9 am and 4 pm on weekdays (GMT +2).
    We will respond to e-mails within two business days.
  7. Disputes
    12.1. Disputes are resolved in accordance with the legislation in force in the Republic of Estonia. If an agreement is not reached, disputes shall be resolved in the Tartu courthouse of the Tartu county court.
    12.2. An online environment of the European Union is open to all clients, through which they can resolve disputes with e-traders. The environment is called the ODR platform (Online Dispute Resolution) and it is available at http://ec.europa.eu/odr.
    12.3 If the e-shop has refused to solve the Client’s complaint or the Client does not agree with the solution offered by the e-shop and thinks that their rights have been violated or their interests have been adversely affected, the Client may file a complaint to the Consumer Disputes Committee through the Consumer Protection Board or to a court. The Client may lodge a complaint himself or through a representative.

  1. Terms of use
    13.1. The Service User must familiarise themselves with the terms and conditions specified in the Contract of Use.
    13.2. By clicking the ‘I agree to the terms of use of the e-shop’ option in the respective place at the moment of ordering, the Service User confirms that they have read the terms and conditions of the Contract of Use, understand them, and agrees with the terms and conditions of the Contract of Use.
  2. Coupons

    14.1 Coupons are shared by the e-shop during public campaigns or personally.

14.2 The coupon validity period is shown in the terms of each coupon.

14.3 The coupon may have a product-specific fixed discount, cart percentage discount, or fixed cart discount.

14.4 It is not possible to use a coupon for a discounted product or for a cart containing products at a discounted price, unless specifically mentioned in the coupon terms.

14.5 The coupon can be used to pay for products in full if the coupon value is equal to or greater than the sum of the products.

14.6 The coupon cannot be used to pay for the shipping of the products unless it is specifically mentioned in the coupon terms.

14.7 The part that exceeds the amount of the coupon and the shipping fee is paid by the Client.
